Agreement to Terms
By submitting an enquiry, completing an eligibility quiz, booking a consultation, or otherwise engaging with Smile Pathways Australia's services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy.
We may update these Terms and Conditions at any time. The "Last Updated" date at the top of this page indicates when these terms were last revised. Continued use of our services following any changes constitutes your acceptance of the updated terms.
About Our Services
Smile Pathways Australia is an independent patient facilitation and referral service. We are not a dental practice, and we do not employ dentists or provide dental treatment of any kind. Our role is to:
- Assess your eligibility for accessing superannuation under the ATO's compassionate release provisions for dental treatment
- Connect you with qualified dental professionals within our partner network
- Coordinate free consultation bookings with partner dental clinics
- Provide general information about the compassionate release of superannuation process
- Refer you to a third-party ATO application facilitator where applicable (see Section 6)
All dental treatment is provided directly by our independent partner clinics. Smile Pathways Australia acts as a referral and coordination service only and is not responsible for the clinical care you receive.
Patient Commitment Fee
To secure your consultation booking, a $50 Patient Commitment Fee is required. This fee covers our coordination costs and ensures we reserve appointment time with our partner clinic for patients who are genuinely committed to exploring their treatment options.
What the fee covers
- Securing your consultation appointment with a qualified dental professional within our partner network
- Our coordination and facilitation services leading up to your consultation
- Ongoing administrative support throughout your consultation process
Refund conditions
- Full refund if you cancel at least 48 hours before your scheduled appointment
- No refund if you cancel with less than 48 hours' notice
- No refund for no-shows without a valid reason (see Section 4)
- No refund if you attend your consultation and choose not to proceed with treatment. This is your decision and we respect it. Our coordination services have been provided.
This is the only fee charged by Smile Pathways Australia for our coordination and referral services. It does not include any fees charged by third-party ATO facilitators, which are governed by separate terms (see Section 6).
Bookings and Cancellations
Cancellation policy
- Cancel at least 48 hours before your appointment: full refund of your Patient Commitment Fee
- Cancel less than 48 hours before your appointment: no refund
No-show policy
If you fail to attend your scheduled consultation without notifying us, your Patient Commitment Fee is non-refundable. We understand that genuine emergencies occur. If you have a valid reason for missing your appointment, such as a medical emergency or serious unforeseen circumstance, please contact us as soon as possible. At our sole discretion, we may offer one opportunity to rebook your consultation without an additional fee.
Rebooking
If you cancelled with at least 48 hours' notice and received a refund, you are welcome to rebook at any time. A new $50 Patient Commitment Fee will apply to the new booking.
How to cancel
To cancel or reschedule, contact us by phone or SMS. Cancellation requests must be received at least 48 hours before your scheduled appointment time to qualify for a refund.
Eligibility and No Guarantee of Outcomes
Smile Pathways Australia provides a general eligibility assessment based on the information you supply. This assessment is indicative only and does not constitute a formal determination of eligibility under the ATO's compassionate release provisions.
The ATO makes all decisions regarding compassionate release applications independently. We cannot guarantee that your superannuation fund will approve a withdrawal or that the ATO will approve your application, regardless of your circumstances or the information you provide to us.
Third-Party ATO Application Facilitator
Where applicable, Smile Pathways Australia may refer you to an independent, third-party ATO compassionate release facilitator to assist with the preparation and lodgement of your superannuation release application.
Important disclosures regarding third-party facilitators
- Any third-party facilitator we refer you to is an independent business. They are not an employee, agent, or subsidiary of Smile Pathways Australia or William Jake Eaton.
- The third-party facilitator's services are governed by their own separate terms and conditions and fee schedule. You should review these carefully before engaging their services.
- Any fees charged by the third-party facilitator are entirely separate from the $50 Patient Commitment Fee paid to Smile Pathways Australia.
- Smile Pathways Australia does not receive any portion of fees charged by the third-party facilitator to you.
- Smile Pathways Australia accepts no liability for the accuracy, quality, timeliness, or outcome of any services provided by the third-party facilitator.
- If your ATO application is rejected, our Patient Commitment Fee remains non-refundable as our coordination services have been provided. Any refund obligations in relation to facilitator fees are governed by the facilitator's own terms.
Not Financial or Medical Advice
All information provided by Smile Pathways Australia, including information about superannuation release processes, dental treatment options, and eligibility criteria, is general in nature only. It does not constitute financial advice, legal advice, or medical advice.
You should seek independent advice from appropriately qualified professionals before making any decisions regarding early superannuation release or dental treatment.
Communications Consent
By submitting an enquiry, completing our eligibility quiz, or booking a consultation, you consent to receive communications from Smile Pathways Australia via phone call, SMS, and email for the following purposes:
- Confirming and reminding you of your booked consultation
- Providing information relevant to your eligibility assessment or booking
- Following up on your enquiry or consultation outcome
- Sending general information about our services that may be relevant to you
You may opt out of marketing communications at any time by replying STOP to any SMS or contacting us directly. Service-related communications, such as appointment confirmations and reminders, are necessary to provide our services and will continue until your engagement with us is complete.
We will handle your personal information in accordance with our Privacy Policy and the Australian Privacy Act 1988 (Cth).
Disclaimers and Limitation of Liability
Dental treatment
All dental treatment is provided by independent partner dental practices. Smile Pathways Australia does not provide dental treatment and accepts no liability for the quality, outcome, safety, or any complications arising from dental treatment provided by any partner clinic. Any concerns about your dental treatment should be raised directly with the treating dental practice.
Partner clinic availability
While we maintain a network of partner dental clinics, we cannot guarantee that a partner clinic will be available in your specific location or that appointment times will suit your schedule. We will endeavour to match you with the most suitable available clinic.
Accuracy of information
We strive to provide accurate and current information. However, information provided by Smile Pathways Australia is general in nature and must not be relied upon as a substitute for professional medical, financial, or legal advice.
Limitation of liability
To the maximum extent permitted by law, Smile Pathways Australia and William Jake Eaton exclude all liability for any loss or damage arising from or in connection with your use of our services, including but not limited to indirect, incidental, or consequential loss or damage. Nothing in these terms limits any rights you may have under the Australian Consumer Law.
Your Responsibilities
When using our services, you agree to:
- Provide accurate, complete, and truthful information at all times
- Attend booked appointments at the scheduled time, or cancel with at least 48 hours' notice
- Review all treatment plans and third-party terms carefully before proceeding
- Seek independent financial advice regarding superannuation release before lodging any application
- Use our services only for lawful purposes and in accordance with these Terms and Conditions
Repeated no-shows or misuse of our services may result in being unable to use our services in the future.
Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Queensland, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Queensland.
If you have a complaint or dispute regarding our services, please contact us in the first instance so we can attempt to resolve the matter directly. We are committed to addressing concerns promptly and fairly.
Severability
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
